1. Our Services
Tribute provides an AI-powered portrait generation service. You upload a photo, we transform it into a classical-style portrait using advanced image generation technology, and you can order it as a high-resolution digital download, a museum-quality printed poster, or a professionally framed print.
2. Eligibility
You must be at least 18 years of age to use this Site and place orders. By using the Site, you represent and warrant that you meet this age requirement.
3. Account and Orders
You do not need to create an account to place an order. When placing an order, you agree to provide accurate and complete information, including your name, shipping address, and payment details. You are responsible for the accuracy of all information submitted.
4. Photo Uploads and Intellectual Property
Your Content: By uploading a photo to our Site, you represent and warrant that you own the photo or have the necessary rights and permissions to use it, including the consent of any identifiable individuals in the photo. You retain all ownership rights to your original photo.
Licence to Us: By uploading a photo, you grant us a limited, non-exclusive, royalty-free licence to use, process, and transform the photo solely for the purpose of generating and delivering your portrait order. We do not use your photos for marketing, training, or any other purpose without your explicit consent.
AI-Generated Portraits: The portraits we create are generated using AI technology. While we strive for quality and likeness, results may vary. The generated portrait is provided to you for personal use.
5. Pricing and Payment
All prices are listed on the Site in US dollars and are subject to change without notice. Prices start at $4.99. Payment is processed securely through Stripe. By placing an order, you authorise us to charge the applicable amount to your chosen payment method. You are responsible for any applicable taxes, duties, or import fees for international shipments.
6. Shipping and Delivery
We ship both domestically within the United States and internationally. Shipping times and costs vary depending on your location and will be displayed at checkout. We are not responsible for delays caused by customs, postal services, or other factors outside our control. Risk of loss passes to you upon delivery to the carrier.
7. Refunds and Returns
We want you to be happy with your order. Our refund and return policy is as follows:
Digital Downloads: Due to the nature of digital products, digital downloads are non-refundable once delivered.
Printed Posters and Framed Prints: If your physical product arrives damaged, defective, or materially different from what was ordered, please contact us within 14 days of delivery. We will offer a replacement or full refund at our discretion.
Buyer's Remorse: Because each portrait is custom-generated from your unique photo, we generally cannot accept returns for change of mind. If you are unsatisfied with the quality, please reach out and we will work with you to find a resolution.
To request a refund or return, contact us with your order number and a description of the issue.
8. Prohibited Uses
You agree not to:
- Upload any photo you do not have the right to use.
- Upload content that is illegal, obscene, defamatory, or infringes on any third-party rights.
- Use the Site for any unlawful or fraudulent purpose.
- Attempt to reverse-engineer, scrape, or interfere with the Site's functionality.
- Resell or commercially redistribute portraits generated through the Site without our written consent.
9. Intellectual Property
All content on the Site, including but not limited to logos, text, graphics, software, and design elements, is the property of Tribute or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, or create derivative works from our Site content without prior written consent.
10. Disclaimer of Warranties
The Site and all products and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the AI-generated portraits will meet your exact expectations. Colours and details may vary between digital previews and physical prints due to differences in screens and printing processes.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Tribute and its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site or purchase of products, including but not limited to loss of data, loss of profits, or personal injury. Our total liability for any claim arising from these Terms or your use of the Site shall not exceed the amount you paid for the specific product giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Tribute and its operators, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site, violation of these Terms, or infringement of any third-party rights, including uploading photos without proper authorisation.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the business operates, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the competent courts of that jurisdiction.
14. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
15. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
